Terms of service

Effective Date: October 3, 2026

OVERVIEW

This website and online store are operated by OFFLIST Travel Inc., operating as OFFLIST TRAVEL ("OFFLIST," "we," "us," or "our").
OFFLIST offers a travel-and-food mail membership featuring thoughtfully curated printed content and destination-inspired pieces shaped by people, stories, food and art. Our website, online store, memberships, products, content, features and related services are collectively referred to as the "Services."
Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer our Services to you.
These Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy, Shipping Policy and Subscription & Cancellation Policy, govern your use of our Services and purchases from OFFLIST.
By visiting our website, using our Services or placing an order, you agree to these Terms. If you do not agree with these Terms, please do not use the Services.
Nothing in these Terms limits any rights or remedies available to you under applicable consumer protection laws that cannot legally be waived or limited.

SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION

By using our Services or placing an order, you represent that you have the legal capacity to enter into the transaction or are otherwise authorized to do so under the laws that apply to you.
You agree to provide current, complete and accurate information when placing an order or creating an account, including your name, email address, billing information and mailing address.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
You are also responsible for keeping your mailing address and other account information current so that OFFLIST mailings can be delivered correctly.

SECTION 2 — OFFLIST MEMBERSHIPS AND PRODUCTS

OFFLIST is a physical mail membership. Membership mailings may include printed letters, illustrated postcards, Eat & Explore Guides, recipe cards, destination stickers and other items identified in the applicable product description.
We make reasonable efforts to accurately describe and display our memberships and products. Because OFFLIST materials are physical printed pieces, colours, paper textures, illustrations, finishes, sizing and other details may vary slightly from what appears on a screen or in photographs.
Small variations resulting from printing, paper stock, illustration, photography, manufacturing or display settings are not considered defects.
We may update, modify or discontinue products, designs, destinations, features or membership offerings from time to time, subject to existing contractual obligations and applicable law.

SECTION 3 — MEMBERSHIP OPTIONS

OFFLIST may offer monthly recurring memberships, prepaid memberships and gift memberships.
The membership options, term, price, currency, payment frequency and renewal terms applicable to your purchase will be clearly disclosed before you complete your order.

Monthly Membership

The Monthly Membership is an automatically renewing membership.
Unless otherwise clearly disclosed before purchase, Monthly Memberships renew on the 21st of each month using the payment method on file.
To avoid the next monthly renewal charge, cancellation must be completed no later than 11:59 p.m. Eastern Time on the 20th of the month.
Cancellation stops future renewals. It does not automatically cancel or refund a membership period that has already been charged or a mailing that has already entered processing, except where required by law or provided under our Refund Policy.

6-Month and 12-Month Prepaid Memberships

Six-month and twelve-month memberships are prepaid for the full membership term.
Unless expressly stated otherwise before purchase, prepaid memberships do not automatically renew at the end of their prepaid term.
The amount charged, length of membership and applicable terms will be displayed before checkout and confirmed in your order confirmation.
Prepaid membership cancellations and refunds are governed by our Subscription & Cancellation Policy and Refund Policy, together with any rights available under applicable law.

SECTION 4 — GIFT MEMBERSHIPS

Where available, OFFLIST memberships may be purchased as gifts.
The purchaser is responsible for providing accurate recipient information, including the recipient's name and mailing address.
A gift purchaser should have permission to provide the recipient's personal information to OFFLIST.
Unless otherwise expressly stated, gift memberships end at the conclusion of the purchased gift term and do not automatically renew.
Where a special designation or promotional status is associated with the purchaser's customer account, including OFFLIST Founding Member status where applicable, that designation belongs to the qualifying purchaser rather than the gift recipient unless the applicable promotion expressly states otherwise.

SECTION 5 — FOUNDING MEMBER STATUS

From time to time, OFFLIST may offer limited membership designations or benefits, including Founding Member status.
Where offered, eligibility requirements and benefits will be described on our website or at the time of purchase.
OFFLIST Founding Member status is limited to qualifying purchasers under the terms of the applicable offer. Founding Member status, once validly awarded, is personal to that purchaser and is not transferable.
Any passport or other product offered to Founding Members in the future is subject to its own availability, pricing and purchase terms unless expressly stated otherwise.

SECTION 6 — ORDERS AND ACCEPTANCE

When you submit an order, you are offering to purchase the selected membership or product on the terms presented to you at checkout.
Your order is accepted when OFFLIST confirms the order following successful payment authorization.
We reserve the right to refuse or cancel an order where reasonably necessary, including because of suspected fraud, payment problems, pricing or technical errors, product availability, misuse of a promotion or inability to fulfill the order.
If we cancel an order after payment has been collected and no applicable product or service has been supplied, we will issue the appropriate refund.
Please review your order carefully before submitting it, including your membership selection, billing information, recipient information and mailing address.

SECTION 7 — PRICES, CURRENCY, TAXES AND PAYMENT

Prices are displayed in the currency applicable to the market in which you are shopping.
For Canadian customers, prices may be displayed and charged in Canadian dollars (CAD). For customers in the United States, prices may be displayed and charged in U.S. dollars (USD). The applicable currency will be shown during checkout.
Unless we clearly state otherwise, standard postage is included in the advertised OFFLIST membership price.
Applicable sales taxes are additional and will be calculated at checkout where required by law.
Government-imposed customs duties, tariffs, import taxes, brokerage charges or similar governmental or border-related charges may apply to some cross-border shipments. Where such charges cannot reasonably be determined or collected by OFFLIST, they may be the responsibility of the recipient to the extent permitted by applicable law.
You agree to provide complete and accurate payment information and represent that you are authorized to use the payment method provided.
By purchasing an automatically renewing Monthly Membership, you authorize OFFLIST and its payment service providers to charge the payment method associated with your membership for recurring payments until the membership is cancelled in accordance with these Terms.
Prices and membership offerings may change from time to time. A pricing change will not retroactively alter a payment already completed.
Changes affecting an automatically renewing membership will be communicated and implemented in accordance with applicable law.

SECTION 8 — SHIPPING AND DELIVERY

OFFLIST currently ships to locations identified as eligible during checkout.
Standard postage is included in the membership price unless expressly stated otherwise.
Delivery dates and transit times are estimates and are not guaranteed. Postal services, weather, customs, border processing, service disruptions and other circumstances outside OFFLIST's reasonable control may affect delivery.
You are responsible for providing a complete and accurate mailing address and for updating your address before the applicable mailing is processed.
If an OFFLIST mailing is returned because the address supplied was incorrect, incomplete or no longer current, additional postage or replacement costs may apply where permitted by law.
If your mailing arrives damaged, incomplete, incorrect or does not arrive within a reasonable period, please contact us at offlisttravel@gmail.com. We will work with you in accordance with our Shipping Policy and Refund Policy.
Nothing in this section limits rights you may have under applicable consumer protection law.

SECTION 9 — CANCELLATIONS, REFUNDS AND REPLACEMENTS

Membership cancellations, refunds, returns and replacement requests are governed by our Subscription & Cancellation Policy, Refund Policy and Shipping Policy.
Those policies form part of these Terms.
Where there is a conflict between these Terms and a mandatory right available to you under applicable consumer protection law, the applicable law will govern.

SECTION 10 — DESTINATION, RECIPE AND EDITORIAL CONTENT

OFFLIST content is created for general information, discovery and enjoyment.
Destinations, restaurants, businesses, attractions, events, operating hours, menus, prices, transportation options and other local information can change. While we make reasonable efforts to provide thoughtful and accurate content when a mailing is prepared, we cannot guarantee that third-party information will remain current.
You should confirm important information directly with the applicable business, attraction, transportation provider or other third party before relying on it.
Recipes and food-related content are provided for general informational and recreational purposes. Individuals are responsible for considering their own dietary requirements and allergies and for checking ingredients and product labels as appropriate.
OFFLIST is not responsible for changes made by independent businesses or other third parties featured in our content.

SECTION 11 — INTELLECTUAL PROPERTY

The OFFLIST website and Services, including our name, branding, logos, written content, illustrations, designs, photographs, graphics, layouts, product concepts and other original materials, are owned by or licensed to OFFLIST Travel Inc. and are protected by applicable Canadian and international intellectual property laws.
OFFLIST content is provided for your personal, non-commercial use.
Unless we give you prior written permission, you may not reproduce, republish, distribute, sell, modify, commercially exploit or create derivative commercial works from OFFLIST content.
Artwork, photography or other creative work contributed by independent artists or other creators may remain the intellectual property of the applicable creator and is used by OFFLIST under licence or other permission.
The OFFLIST TRAVEL name, branding and associated marks may not be used in a way that suggests affiliation with, sponsorship by or endorsement from OFFLIST without our written permission.
Shopify's trademarks and other third-party names and marks remain the property of their respective owners.

SECTION 12 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools or services supplied by third parties, including payment processors, subscription-management providers, analytics services and other technology providers.
Those third-party services may be governed by their own terms and privacy practices.
To the extent permitted by law, OFFLIST is not responsible for third-party services that we do not own or control.
We may add, modify or discontinue optional tools or features from time to time.

SECTION 13 — THIRD-PARTY LINKS AND BUSINESSES

Our website and OFFLIST materials may mention or link to restaurants, accommodations, attractions, artists, retailers, organizations, websites or other third parties.
Unless expressly stated otherwise, those third parties are independent from OFFLIST.
A mention, illustration, recommendation or link does not mean that OFFLIST owns, operates or controls the third party.
We are not responsible for the content, policies, availability, products or services of independent third parties.
Transactions between you and a third party are governed by the terms applicable to that third party.

SECTION 14 — RELATIONSHIP WITH SHOPIFY

OFFLIST TRAVEL is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make in our store are made directly with OFFLIST Travel Inc.
By using the Services, you acknowledge that Shopify is not the seller of OFFLIST memberships or products and is not responsible for the performance of OFFLIST's obligations to you.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages or liabilities arising from purchases made directly from OFFLIST.

SECTION 15 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify and uses third-party service providers, certain personal information may be processed by Shopify and other service providers that help us operate the store, process payments, manage memberships and deliver our Services.
Some service providers may process information outside the province or country in which you reside.
Please review our Privacy Policy for more information about how personal information is collected, used, disclosed and protected.

SECTION 16 — FEEDBACK, REVIEWS AND SUBMISSIONS

If you voluntarily send OFFLIST a review, suggestion, idea, comment, photograph or other submission ("Feedback"), you represent that you have the right to provide it.
Unless otherwise agreed in writing, you grant OFFLIST a non-exclusive, worldwide, royalty-free licence to use, reproduce and display Feedback for legitimate business purposes, including operating, improving and promoting OFFLIST.
This licence does not transfer ownership of your Feedback to OFFLIST.
We will not knowingly use private communications as public testimonials without appropriate permission.
You must not submit content that infringes another person's intellectual property, privacy or other legal rights or that is unlawful, defamatory, abusive, fraudulent or malicious.

SECTION 17 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, membership information or other matters.
We may correct genuine errors or update information when reasonably necessary.
If an error materially affects an order you have already placed, we will address the matter in accordance with applicable law and, where appropriate, provide you with an opportunity to confirm the corrected transaction or receive a refund.

SECTION 18 — PROHIBITED USES

You may use the Services only for lawful purposes.
You may not use the Services in violation of applicable law; to infringe intellectual property or other legal rights; to submit fraudulent, false or misleading information; to introduce viruses, malicious code or other harmful technology; to interfere with the security or operation of the Services; to collect personal information about others unlawfully; to impersonate another person or entity; to engage in fraudulent transactions or payment activity; to scrape, reproduce or commercially exploit OFFLIST content without authorization; or for any purpose that materially interferes with another person's use of the Services.
We may restrict or terminate access where we reasonably believe these Terms have been materially violated.

SECTION 19 — TERMINATION

You may stop using our website at any time.
Membership cancellations are governed by the applicable membership terms and our Subscription & Cancellation Policy.
We may suspend or terminate access to the Services where reasonably necessary because of fraud, unlawful activity, material breach of these Terms or conduct that threatens the security or integrity of our Services.
Termination does not affect rights or obligations that arose before termination.
Provisions that by their nature should continue after termination, including provisions relating to intellectual property, liability, governing law and outstanding payment obligations, will survive.

SECTION 20 — WARRANTIES AND CONSUMER RIGHTS

We work to provide OFFLIST products and Services with reasonable care.
Except for warranties or conditions expressly provided by OFFLIST or imposed by applicable law, and to the maximum extent permitted by law, the Services are provided on an "as available" basis.
We do not guarantee that the website will always be uninterrupted, error-free or available.
Nothing in these Terms excludes, restricts or modifies any warranty, condition, right or remedy that cannot legally be excluded, restricted or modified under applicable consumer protection or other law.

SECTION 21 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, OFFLIST Travel Inc. and its directors, officers, employees, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential losses arising from your use of the Services where such liability may legally be excluded.
This limitation does not apply to liability that cannot lawfully be excluded or limited, including any rights or remedies available under applicable consumer protection legislation.
Nothing in these Terms is intended to exclude liability for fraud, wilful misconduct or other liability that cannot legally be excluded.

SECTION 22 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold OFFLIST Travel Inc. and its directors, officers, employees, contractors and service providers harmless from third-party claims, losses or reasonable legal costs resulting from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's intellectual property or legal rights.
This section does not require you to indemnify OFFLIST for losses caused by OFFLIST's own unlawful conduct or where such indemnification is prohibited by law.

SECTION 23 — SEVERABILITY

If a court or other competent authority determines that part of these Terms is unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed where necessary.
The remaining provisions will continue in effect.

SECTION 24 — WAIVER AND ENTIRE AGREEMENT

If OFFLIST does not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.
These Terms, together with the policies incorporated into them and the specific terms presented to you at checkout, constitute the agreement between you and OFFLIST concerning your use of the Services and your applicable purchase.
Nothing in this section limits rights that cannot legally be waived.

SECTION 25 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written consent, except where applicable law provides otherwise.
OFFLIST may assign or transfer its rights and obligations in connection with a legitimate corporate reorganization, financing, sale, merger or transfer of all or substantially all of the relevant business, subject to applicable law.

SECTION 26 — GOVERNING LAW

These Terms and your use of the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.
Subject to any rights you may have under applicable consumer protection legislation to bring a claim in another jurisdiction, disputes relating to these Terms will be subject to the jurisdiction of the courts of Ontario.
Nothing in this section limits any mandatory consumer right or remedy available under the laws applicable to you.

SECTION 27 — CHANGES TO THESE TERMS

You may review the current version of these Terms on our website at any time.
We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.
Where a change materially affects an existing membership or where notice is required by law, we will provide notice in accordance with applicable law.
Changes will not retroactively remove rights that have already accrued.
Your continued use of the Services following the effective date of an applicable update constitutes acceptance of the updated Terms to the extent permitted by law.
